Tis Hazari Court of Delhi has refused to grant anticipatory bail to Bibhav Kumar in Swati Maliwal case. The court has rejected the anticipatory bail of Bibhav Kumar.
During the hearing, the Additional Public Prosecutor told the court that Bibhav Kumar has been arrested. Therefore, the court said that the anticipatory bail petition has become ineffective.
Senior advocate N Hariharan appeared for Bibhav Kumar. At the same time, Aam Aadmi Party’s legal cell head Sanjeev Nasiyar had also reached Tis Hazari Court. Bibhav Kumar’s lawyer N Hariharan completed his arguments. After this, the government lawyer said that the facts presented by Bibhav’s lawyer are a one-sided picture.
The court should not take any decision to grant any relief without the response of the investigating officer (police). After the response of the investigating officer, it will be decided what are the real facts of the case?
What did Bibhav’s lawyer Hariharan say in the court?
During the hearing in the court, the lawyer said that we had to harass you on Saturday. Bibhav is present in the police station. No notice has been given to the accused in this case.
Advocate Hariharan said, no one can believe the allegations made. Right now we do not know about Bibhav’s condition, we suspect that he may be arrested. The allegations that Swati Maliwal is making are beyond comprehension. Why Bibhav would start fighting like this is beyond comprehension! Why would anyone do such a thing at the CM’s residence?
Hariharan told the court that as per the records, Swati had not taken the appointment and this was a breach in the security of the CM. Hundreds of people were present there. If Swati had been assaulted, she would have screamed and the people present there would have heard it.

Earlier, Delhi Police on Saturday arrested Chief Minister Arvind Kejriwal’s personal secretary Bibhav Kumar in connection with the alleged assault on Aam Aadmi Party (AAP) MP Swati Maliwal. The Delhi Police team reached the Chief Minister’s residence on Saturday afternoon, from where it took Bibhav Kumar with itself.
In the FIR lodged with Delhi Police, Maliwal has alleged that she had gone to meet Kejriwal at his camp office residence on Monday morning. While she was waiting for the CM in the drawing room, Bibhav Kumar came there and assaulted her. He was beaten badly and even slapped and kicked. After the complaint, the police got the AAP MP medically checked. Its report also came out on Saturday.
